Executive summary
Romania is in a very beginning period of implementation of electronic invoices systems. Even if the directive 2001/115/EC is transposed in the Law 206 / 2007, the methodology for implementation is still missing. The Romanian actors are not prepared yet for this challenge and there are some obstacles which affect this process, like the following: * the legislation is still confused * the digital certificates are not used in the large amount * the accounting audit entities are not prepared However, the requirements of integration in the European economy impose for the future the development of such systems. The Romanian market is an emergent market and in the next period the existing insulated systems will be developed. It is the time for foreign companies to come in Romania and to promote their solutions in co-operation with Romanian actors.Legal aspects
The legal instruments that underlie the invoicing and the invoicing modalities in Romania are the following:• Law no.82/1991 – Accounting Law (republished)

• Law no.451/2004 – electronic stamp
• Directive nr.54/2005 – authority procedure for certification services providers
• Law no. 260/ 20007 - recording of the commercial opperation through electronic means

The official body nominated to elaborate the methodology for electronic invoices is "The National Authority for Communications - the institution that sets the rules in the Romanian communications market and watches the enforcement of these rules.

However, the electronic invoice Romanian specific law is not fully aligned with the European Directive, and for this reason there is an initiative at the level of Ministry of Communication and Information Technologies together with the Ministry of Public Finance to establish a working group for electronic invoice, but till now is at level of intention only.
